In the following we inform you in detail about our data protection policy and the data processing carried out by us, in particular of those data which are collected on our homepage under the URL http://es.schindhelm.com (hereinafter referred to as the "homepage").

Our DPO is in charge of the proper processing of your data in accordance with the General Data Protection Regulation (hereinafter referred to as "GDPR") and the Spanish legislation and takes care of the following points, among others:

  • to inform and advise the partners, collaborators and service providers of Lozano Schindhelm about their obligations in the field of data protection;
  • to monitor and verify the observance of the data protection regulations and the corresponding data protection policy of Lozano Schindhelm by all parties involved, including the allocation of concrete responsibilities, creating awareness of problems, further training and the corresponding checks;
  • to cooperate with the Spanish Data Protection Authority and other European agencies;
  • he acts as a contact person with the Spanish Data Protection Authority for questions related to data processing, including replying to requests.

The DPO shall perform his functions with particular attention to the risks associated with data processing, taking into account in particular its nature, scope, context and purpose.

3. Access to our homepage

We automatically collect and store the so-called dial-in archive data that your browser reports to us. These are:

- Type/version of browser,

- Operating system,

- Reference URL,

- URL of the page you are accessing on the home page,

- IP address of the access device,

- Name and URL of the requested file,

- Number of data transferred,

- Notification that the recovery has been performed correctly, and

- Date and time of access to the homepage.

The collection of this data is necessary for technical reasons. Unfortunately, it is technically not possible to use the homepage without transmitting the IP address.

4. Cookies

The use of our homepage is associated with the generation and use of cookies, if you agree to these via the banner displayed. Cookies are small text files that our server transfers to the browser of your terminal device, where they are stored. The browser of your terminal device is regularly configured in such a way that it accepts the generation and storage. The data collected by Google is usually transferred to a Google server in the USA, where it is stored. Google uses this data to analyse the use of the homepage, to create reports on the use of the homepage and to offer us further services connected with the use of the homepage and the Internet.

The processing by Google and etracker of data relating to the analysis of the use of the homepage serves the general objective of Lozano Schindhelm of adapting the homepage as best as possible to the needs and wishes of its users.

Google operates under the EU-US privacy shield and is currently classified accordingly.

To guarantee the anonymous collection of IP addresses, Google has added the code "_anonymizeIP" to its source code. This means that the IP addresses are only processed in abbreviated form to prevent them from containing any personal reference. The IP address of your browser transmitted as part of Google Analytics is not mixed with other Google data.

5. Contact form

Via the tab "Contact" you can send us questions or suggestions. After having clicked on the link, you can fill out a contact form online with some personal data. The fields marked with an asterisk must always be filled in (name, surname, postal code, city, country, address, e-mail address and your message). All fields, whether mandatory or voluntary, are used to process your request.

We reserve the right not to respond to your request if you do not provide us with the mandatory information.

Please keep in mind that you can find the e-mail address of our employees on the homepage under the section Team (link) if you wish to contact a specific person.

6. Newsletter subscription

When you subscribe to our newsletter in the "News & Jusful" section, we collect and use your e-mail address to inform you about current legal issues by sending you our newsletter. To register, we use the "double opt-in" procedure. This means that after your registration we will send an e-mail to the given address asking you to confirm your registration. The e-mail address is mandatory. The other data are voluntary and serve us to be able to attend to you personally.

The processing of the data related to the dispatch of the newsletter serves customer loyalty and to offer you our team and the services offered by us. If you do not enter your e-mail address, we will not be able to send you the newsletter. If you do not provide any other voluntary information, we simply cannot address you personally when sending the newsletter.

If you register for the newsletter, you expressly consent to the receipt of newsletters as follows:

"I agree that Lozano Schindhelm informs me regularly about current legal topics and news of Lozano Schindhelm and the Schindhelm-Allianz. I may revoke this consent at any time in the future with immediate effect, but not retroactively".

If you no longer wish to receive the newsletter, you can unsubscribe at any time. You can also do this by clicking on the corresponding link in the newsletter itself or by sending a message without a special form, e.g. by e-mail to our DPO or to any of our offices.

7. Unsolicited application

Under the section "Vacancies" we offer you the opportunity and inform you about how you can send us an unsolicited application by e-mail and how you can participate in the currently open application procedures.

The data provided to us in this connection will help us to determine whether you are suitable for a vacancy or future position in our firm, in another Schindhelm Allianz office or that is offered by our collaboration partners or clients.

Any further storage or use of the applicant's data will only take place if he/she gives us his/her express consent to do so.

8. Application for the scholarship Lozano Schindhelm 

Under the section "Scholarship Lozano Schindhelm" you can send us your application. The data collected will be processed in accordance with the conditions of participation.

9. Forms included in the subcategories of our competences

In some categories, you have access to a form which you can use to make enquiries about the covererd subjects. These forms are fully subject to the provisions of point 5.

10. Legal and contractual obligations to provide data

Each submission of data on your part is completely voluntary, with the exception of the collection of data described under numbers 3 and 4 as a result of your decision to visit the homepage. The submission of data is in any case not a legal or contractual obligation.

11. Transfer of your data

We will only pass on your data to third parties (processing agents) if we are by your consent entitled or legally obliged to do so. The same applies if we receive your data from third parties, i.e. neither from you nor from subcontracted companies.

The consent includes both the collection of data by third parties for us on behalf of our company and the transfer of this data to us, as well as the transfer by us to other companies and the processing by them on our behalf.

The last-metioned applies in particular if we do not carry out special commercial activities ourselves (such as the operation of the homepage, the creation and dispatch of the newsletter), but have sub-contracted all or part of these activities to other companies and these activities are connected with the processing of your data. In these cases, we have contractually obliged these companies to use the data only for the purposes permitted by law.

The processing by third parties is governed by a written contract (data transfer contract), which expressly states that the person in charge of processing processes your data exclusively in accordance with the instructions of the data responsable (us), that he/she does not apply or use them for any purposes other than those specified in the contract, and that he/she does not communicate them to other persons, not even to store them. In this respect, the contract sets out the security measures that the data controller must implement and other various instructions on data processing.

For example, there is a legal obligation to pass on data to police and customs authorities.

12. Your rights (objection, revocation, information, correction, deletion, limitation of processing, data transferability, complaint)

12.1 Right to object to data processing

You can object to the processing of your personal data at any time. For this purpose, you can use the contact options described under numbers 1 and 2. If you object to the processing of your personal data, we will not process them unless we can prove convincing grounds for protection which speak in favour of processing and outweigh your interests, rights and freedoms.

12.2 Revocation of consent

You also have the right to revoke your consent with effect for the future. The legality of the processing based on your initial consent will not be affected by the revocation.

12.3 Right of information

You have the right to demand that we provide you with information as to whether your personal data will be processed. In addition, you may request further information on the specific purposes of the processing, the categories of personal data, the third parties to whom they are disclosed or the categories to which they relate, the duration of the storage, the existence of a right to cancel or correct your personal data or the limitation of the processing and the right to object, the existence of a right to object and any information relating to the origin of your data if we do not collect the data directly from you.

12.4 Right of correction

You have the right to ask us to correct your personal data. This right includes the correction of inaccurate data and the completion of incomplete personal data.

12.5 Right to delete data

You have the right to request the immediate cancellation of your personal data if one of the reasons mentioned in Art. 17, paragraph 1, a) to f) of the RGPD applies (for example, if the personal data is no longer required for the further pursuit of the purposes for which it was collected).

12.6 Restrictions on processing

You have the right to request the limitation of the processing of your data.

12.7 Right to data transfer

You have the right to have your personal data collected in a structured standard format and communicated to another data responsable (e.g. to another law firm).

12.8 Right of complaint

You have the right to submit a complaint to the Spanish Data Protection Authority. Any other request can be sent to us using the contact details mentioned in paragraphs 1 and 2.

13. Data security

In accordance with Art. 32 RGPD, we undertake to take appropriate technical and organisational measures for data security, taking into account the state of the art, the implementation costs and type, scope, circumstances and objectives of the data processing, as well as the probability that an infringement of the rights and freedoms of natural persons will occur, and their possible severity.

We have already taken reasonable and appropriate measures to protect your personal data from loss, destruction, alteration and disclosure by unauthorized persons. These measures allow us in particular:

- To guarantee the confidentiality, correctness, availability and resistance of the systems and services related to data processing.

- To ensure a rapid recovery of the availability of personal data in the event of a physical or technical incident.

- To control any possible security problem related to the data before the specialized and competent authorities, if the security should be compromised by mass or individual cyberattacks.

In addition, we carry out procedures for regular evaluation, checking, securing and evaluation of technical and organisational measures for the security of data processing.

In any case, we ask you to bear in mind that we make every effort to provide a secure and trustworthy homepage for the users and to process your data in strict compliance with the legal requirements in accordance with the policy outlined and the measures described. However, absolute confidentiality of the communication and documents transmitted from or to our homepage or via any electronic channel can never be permanently guaranteed.
